The Equal Employment Opportunity Commission (EEOC) has just lost a lawsuit on behalf of a deaf man who claimed employment discrimination. A U.S. District Court just ruled that a mining company did not discriminate when they would not hire a deaf man as a truck driver or heavy equipment operator. The deaf man may have sunk his own case when, according to the company, he allegedly admitted during the interview that he could not perform the job's essential tasks. (Remember, it is not discrimination if someone can not perform the essential tasks of a job). Not only that, the company claimed he would have been a safety threat to other employees if they had hired him.


There seems to be important details left out. Why was the case brought at all, if the deaf guy admitted he could not do the job?
Since there ARE deaf people doing heavy machinery operation and driving trucks, it baffles me how bringing this case could help the EEOC protect their rights.
I hope there is more story to this as well. Like maybe he have a history or something. Because there are way too many deaf people who operate heavy machine and drivers and this lawsuit could open the door to discriminate.
