Update on Deaf Shoplifter Choking Case

The security guard who choked the suspected deaf shoplifter has been suspended from his job.  The shoplifter, Alejandro Rea, and his brother, are threatening a lawsuit (no surprise)  although there is a possibility of settling out of court. The news reports reveal that the guard did more than just choke Rea; he also threw Rea against the wall twice. In the meantime,  Rea is in prison on felony second-degree robbery charges.

He is i jail, NOT prison.

Interesting that you don’t say what Rea did. Oh yeah, he is deaf so it’s o.k.

ugh! this changes things. It appears he was actually shoplifting, or there was at least enough evidence to warrant an arrest. In my mind it stops being a deafness issue, and is now mostly an excessive use of force issue.

Is the robbery charge from the occurrence in question? According to this site: http://www.latheftattorney.com/
A key difference between shoplifting and robbery is the use of threat or force.
If he is being charged with robbery and not shoplifting in this case there is much much more going on than what appears on the surface.

Alejandro Rea is a twice convicted THIEF. He and his brother were caught STEALING from the store and attacked the security personnel in their attempt to flee the FELONY they had just committed. Instead of demanding security guards learn sign language – you should train Alejandro Rea to STOP COMMITTING FELONIES!

Ed Wood, what Rea did was wrong, however two wrongs don’t make a right.

The security guard should be charged with assault.

Mr. Rea’s stories makes all sick to all people. Why did
his attorney support his A.D.A. rights against Forever XX1 store for thief purposes?

It is not fair reasons that other many deaf people complained that any Los Angeles County deaf agency will not able to help to deaf people to get any A.D.A. attorney to fight their A.D.A. rights in Los Angeles, California for a long time.

WHO WILL CARE TO HELP TO OTHER DEAF PEOPLE TO GET
ANY A.D.A. ATTORNEY IN LOS ANGELES, CALIFORNIA NOW?

Come on. He was a thief. I don’t care if he was a Deaf thief or a Blind thief…or a Democrat/Republican thief. Bottom line, he was stealing. This is the main problem, if he wasn’t stealing then he would not have been choked out. All the security guard haters out there, what would you have done if it was your store? Kindly ask the thief to stop and put the merchandise back? Sorry but it doesn’t work that way. The thief kept trying to get away. Plus, the security guard didn’t know if the thief had a knife or any weapon. So, why take the chance? He kept the choke hold on him for a reason. Put yourself in his shoes instead of standing up for a THIEF just because he is Deaf.

I think what may have happened here is that when security spoke to the suspect, the suspect did not respond. Then security took this as a sign that the suspect was not cooperating and then use excessive force. I have been ‘yelled ” at by cashiers and given dirty looks because they have said something to me and I did not respond, because I am deaf. It doesn’t matter if I was breaking the law or not, miscommunication should not lead to agressive behavior.

Randy, like someone said, two wrongs don’t make a right. Yes, Rea did steal something. But the sticky point is, the security guard did something wrong, in terms of putting Rea in a chokehold and according to another article, slamming him against a wall not once, but twice.. Many law enforcement and security people have been ordered to never put someone in a chokehold. There are other ways to restrain people.

You can see that Rea was saying multiple times that he was deaf, and that he was willing to surrender, but the guard just kept going after him. There’s such thing as overkill.

Either way, both were wrong in what they did.
